Agreement to Terms

2. User Responsibilities

• Compliance with Laws: Users must comply with all applicable federal, state, and local laws and regulations related to the sale, purchase, and transfer of firearms, ammunition, and related items.
• Accurate Information: Users are responsible for providing accurate and truthful information when creating accounts, listing items, and conducting transactions.
• Prohibited Activities: Users shall not:
• Engage in fraudulent, deceptive, or misleading practices.
• List or sell prohibited items, including but not limited to illegal firearms, stolen goods, or items not compliant with applicable laws.
• Infringe upon the intellectual property rights of others.
• Interfere with the operation of the Site or Services.

 

3. Account Registration

 

To access certain features of our Services, you may be required to register for an account. You agree to:

• Provide accurate, current, and complete information during the registration process.
• Maintain and promptly update your account information.
• Maintain the security of your account credentials.
• Accept responsibility for all activities that occur under your account.

 

4. Listings and Transactions

• Listing Items: Sellers must ensure that all listings are accurate, complete, and comply with our guidelines and applicable laws.
• Transactions: All transactions must be conducted in accordance with applicable laws and regulations, including mandatory background checks and transfers through licensed firearms dealers where required.
• Fees: We reserve the right to charge fees for certain services. Any applicable fees will be disclosed prior to the completion of a transaction.

 

5. Shipping and Delivery

• Compliance: All shipments of firearms must comply with federal, state, and local laws, including shipping only to licensed firearms dealers when required.
• Responsibility: Sellers are responsible for ensuring that shipments are packaged securely and shipped in compliance with all legal requirements.

 

6. Dispute Resolution

• Between Users: Users are encouraged to resolve disputes amicably. We may assist in mediating disputes but are not obligated to do so.
• With Gunmarket: Any disputes arising between you and Gunmarket shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

 

7. Limitation of Liability

To the fullest extent permitted by law, Gunmarket shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use our Services.
• Any unauthorized access to or use of our servers and/or any personal information stored therein.
• Any interruption or cessation of transmission to or from our Services.
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Services by any third party.
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Services.

 

8. Indemnification

You agree to indemnify, defend, and hold harmless Gunmarket and its affiliates, officers, agents, and employees from any claims, liabilities, damages, losses, and expenses, including without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any rights of another.

 

9. Intellectual Property

• Ownership: All content and materials on the Site, including but not limited to text, graphics, logos, and software, are the property of Gunmarket or its content suppliers and are protected by intellectual property laws.
• License: We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Site and Services for their intended purposes, subject to your compliance with these Terms.

 

10. Termination

We reserve the right to suspend or terminate your account and access to our Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

 

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.

We may modify these Terms at any time. We will notify you of any changes by posting the new Terms on the Site and updating the "Last Updated" date. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.

Seller Verification and Compliance Terms

1. Eligibility to Sell Firearms and Regulated Items

All sellers listing firearms, ammunition, or any regulated item on this platform must:

• Be a legally recognized entity (e.g., Federal Firearms Licensee “FFL”) or an individual legally allowed to sell such items.

• Possess all required licenses, permits, or certifications necessary for lawful commerce in their jurisdiction.

• Undergo verification prior to approval, including submission of current FFL credentials (if applicable) and government-issued ID.

2. Verification Process

Sellers agree to:

• Submit accurate, truthful, and up-to-date identification and license information.

• Cooperate with background checks or license verification procedures initiated by the platform or its compliance partners.

• Promptly notify the platform of any changes in licensing status, business operations, or legal eligibility.

Failure to pass verification or maintain valid licensing will result in account suspension or termination.

3. Compliance with Federal and State Laws

Sellers are responsible for:

• Ensuring that all listings and transactions comply with Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) regulations, Gun Control Act, state laws, and applicable local ordinances.

• Shipping firearms only to licensed FFL holders via verified FFL-to-FFL transfer protocols.

• Complying with age restrictions, waiting periods, and background check requirements as applicable by law.

• Maintaining accurate sales records and adhering to all mandatory reporting and recordkeeping obligations.

4. Platform Rights and Monitoring

• The platform reserves the right to review, approve, suspend, or remove listings at its discretion to ensure compliance.

• The platform may audit seller activity and require documentation of legal transfers or buyer verifications.

• Any suspected illegal activity will be reported to the appropriate law enforcement agencies.

5. Prohibited Conduct

Sellers may not:

• List items prohibited by federal or state law, including but not limited to unregistered NFA items, unserialized firearms, or items defined as “ghost guns.”

• Circumvent or attempt to bypass any compliance requirement set by the platform.

• Use the platform to conduct private transfers without compliance with all applicable laws.
